AVOIDING COMMON MISTAKES DURING THE DIVORCE PROCESS

BAD PARENTING

In a divorce involving children, the Judge will be highly focused on the most recent evidence of parenting that is available.  Parents who leave children without adequate supervision, introduce children to a new paramour, use illegal drugs or excessive alcohol, speak negatively of the other parent, or refuse to allow the spouse to have reasonable and flexible contact with the children will significantly harm their chances of winning custody.

BAD COMMUNICATION

Judges like to see that parents can communicate well with each other, despite their disagreements.  Parents that communicate in a threatening manner or with foul language will not earn the respect of the Judge.  Parents that communicate with respect, humility and openness will benefit the children and will greatly improve their chances of winning their case.

FINANCIAL IRRESPONSIBILITY

Spouses that waste or hide money during the pendency of a divorce will find that they have lost the Judge's respect and trust, and that the Judge may order that the innocent spouse be reimbursed for the lost money.  Spending money on jewelry or other gifts for a new paramour is a particularly bad idea, even if the money is spent after separation of the spouses.
